Harmonea provides an AI-powered trading companion designed to improve traders well-being, guided breathwork exercises, trading performance assessments, and an insight dashboard for traders. These services are intended for individual use to foster a positive and productive trading environment.
3. License and Usage Rights
Harmonea grants users a limited, non-exclusive, non-transferable license to use the platform, subject to these Terms and Conditions. This license is restricted to internal organizational use and may not be transferred, resold, or sublicensed to any third party.
4. User Obligations and Acceptable Conduct
Users must use Harmonea responsibly and in compliance with all applicable laws and regulations. Unauthorized sharing of login credentials, modifying the software, or using the platform for unlawful activities is strictly prohibited. Users must not engage in activities that could harm Harmonea or its reputation.
5. Intellectual Property Rights
All intellectual property on Harmonea, including AI models, platform interface, logos, designs, and software, remains the exclusive property of Harmonea. Unauthorized use, replication, or distribution of Harmonea's proprietary materials is prohibited.
6. Privacy and Data Protection
Harmonea is committed to protecting user data in compliance with applicable data protection laws. Please refer to our Privacy Policy for detailed information on how data is collected, used, stored, and protected. The Privacy Policy is incorporated into these Terms and Conditions by reference.
7. Data Sharing and Aggregated Insights
Harmonea collects and uses anonymized, aggregated data to provide mental health insights to user and to improve its services. Data collected for these purposes is fully anonymized to maintain user confidentiality.
8. Fees, Payments, and Refunds
Harmonea offers a 30-day money-back guarantee for new subscriptions. Payment is required based on the selected billing cycle, which may include monthly or annual billing. Harmonea also reserves the right to change pricing after each billing cycle for the next cycle. Refunds will be handled based on specific circumstances, and Harmonea reserves the right to determine eligibility for refunds.
9. Termination Clause
Both Harmonea and users have the right to terminate services. Users may terminate their subscription by following the account cancellation steps, while Harmonea may terminate access at any time, including in cases of misuse, breach of terms, non-payment, or any other violation of these Terms and Conditions. If Harmonea terminates access due to misuse, breach of terms, non-payment, or other violations, no refund will be provided for the remaining time of the billing cycle. However, if Harmonea terminates access based on a decision without any specific reason from the aforementioned categories, a refund for the remaining payments of the active billing cycle will be provided. Termination by the user within an active billing cycle does not provide a refund for the remaining time of the cycle. Upon termination, Harmonea will delete all user-related data, unless otherwise required by applicable law.
10. Limitation of Liability
Harmonea shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use the platform. Users acknowledge that they use the Harmonea platform and its services at their own discretion and risk. Harmonea provides offers and recommendations for mental wellness, but users are solely responsible for their decisions based on these recommendations. Harmonea is not responsible for any financial or psychological losses incurred as a result of using its services, including any actions or decisions taken based on the platform's guidance.
11. Disclaimer of Warranties
Harmonea is provided "as is," without warranties of any kind, either expressed or implied. The AI mental health companion is intended to provide support and well-being guidance, but it should not replace professional medical care or therapy.
12. Governing Law and Dispute Resolution
These Terms and Conditions are governed by the laws of Canada, without regard to conflict of law principles. Any dispute arising from or relating to these terms will be resolved through mediation or arbitration as agreed by both parties before pursuing formal legal action.
13. Confidentiality and Security
Harmonea takes confidentiality and data security seriously. Users agree to maintain the confidentiality of their access credentials, and Harmonea will employ commercially reasonable measures to protect user data from unauthorized access.
14. Availability of Service
Harmonea aims to provide its services, including the AI mental health companion, as a 24/7 offering. However, Harmonea makes no guarantees regarding the availability or uninterrupted access to any specific service, feature, or the entire platform. Harmonea is not obligated to maintain continuous service availability and may suspend, modify, or limit access to any part of the product at its discretion, without prior notice.
15. Third-Party Integrations and Links
Harmonea may include integrations or links to third-party services. Harmonea disclaims all responsibility for the content, functionality, or privacy practices of any third-party services linked through the platform.
16. Compliance with Laws
Users are responsible for ensuring compliance with local laws and regulations when using Harmonea, including data protection, privacy laws, and health regulations. Harmonea disclaims any liability for non-compliance by users.
17. Modifications to Terms
Harmonea reserves the right to modify these Terms and Conditions at any time without further notice. The updated version of these terms is available here, and we encourage you to review it periodically. Continued use of the platform constitutes acceptance of any modified terms.
18. Email Communications
By creating an account or using Harmonea ("the Service"), you consent to receive electronic communications from us, including but not limited to: account updates, service notifications, promotional offers, surveys, newsletters, and customer service responses. You may opt out of receiving promotional emails by following the unsubscribe link included in such communications. However, you acknowledge that certain essential communications regarding your account and use of the Service (such as transactional emails) are mandatory and cannot be opted out of unless you delete your account.
